Historically, the type of crimes which were federal offenses were very limited. The federal courts originally were set up to only deal with things that would be beyond the state jurisdiction, such as kidnapping across state lines (that’s the famous one) and then things that happen on federal property – things that had to do with the money system and the banking system – bank robberies, historically, were always handled in federal court.
In about the 1980’s all of that changed. Comprehensive laws were passed which basically brought everything that could be in a crime in a state under the possibility of being charged with a crime in federal court. These include, of course, bank robbery, but also fraud, kidnapping, even murder under certain circumstances. And so, there are a number of cases that are made in federal court now that were not made historically, and it became a big factor over the last thirty (30) years in terms of the criminal prosecutions which occur. The federal system is very different from the state system, and it’s something that can be a bit overwhelming for people. In addition, many lawyers do not practice in the federal court for these reasons, so it’s very important that you make sure that you have a good federal court qualified team of lawyers who are there to defend you.
