Sometimes ICE agents show up and want to talk to employees. The ICE agents could be there because there’s an immigration issue or there could be a different type of issue. Certainly, in terms of talking to the employee, as an employer you don’t necessarily have the authority to tell the individual whether to talk or not. So, you may think that they should talk, and the individual may not want to. The individual has the right to either give a statement or not. The individual has the right to seek legal counsel or not. You as the employer probably have a vested interest in determining how that process goes. Some employers will contact lawyers in order to assist the employees, to make sure the employee will be okay. That’s something to consider. Anytime you’re talking to law enforcement, it’s probably a good idea to get some legal advice, at least until you know what the extent of the investigation and the reasons for the questioning are.
