If a person is charged with DUI and convicted, then the second DUI is what’s called a second offense, or “DUI second,” which has enhanced penalties and it’s more serious. You can also have a situation though, where a person is charged with a DUI, has not been to court yet, receives another DUI violation, and, in that instance, both of those are considered first offenses.
